AARP and Siteworx - AARP Multichannel Web Content Management Deployment

Judging

Judging process

2011 MAX Award finalists will be determined by a series of MAX Awards Judging Councils, one for each category. Each Judging Council consists of a team of Adobe experts and industry representatives with comprehensive knowledge of the category. Each application will be reviewed first by members of the MAX Awards team to determine which submissions will enter the semifinalist round. The semifinalists will be reviewed by the MAX Awards Judging Councils for each category. Council members may be on the council for more than one category. Judging Councils will review and rate each submission. The category finalists will be selected from the three highest scores in each category, and all scores will be kept confidential. Entrants will also be eligible for Honorable Mentions. Honorable Mentions honor outstanding achievement, granted at the discretion of the Judging Councils, and are announced prior to the Adobe MAX conference, which takes place October 1–5, 2011. Adobe reserves the right to not award any Honorable Mentions.

The Category Winner will be selected from one of the top three finalists from each of the six (6) categories through online public voting. Online public voting will open on Tuesday, September 27, 2011, and close on Tuesday, October 4, 2011, at noon (Pacific Time). Online voting will be limited to one vote per email address. Category winners will be announced during the MAX Awards ceremony at Adobe MAX 2011 in Los Angeles.

Judging criteria

Submissions for the 2011 MAX Awards will be judged on the strength of their submissions and alignment to the following criteria.

  • Quality of end-user experience, with an emphasis on experiences that push the boundaries of creative expression and originality, and have an undeniable, universal visual appeal
  • Reach and monetization of the application, with proven success at increasing revenue and profitability, opening new revenue channels, and providing customers or audiences with more and newer ways to engage with services and information
  • Breadth of Adobe solutions used to develop the application
  • Ability of the application to engage audiences across multiple channels, such as social media and other avenues, to bring audiences into two-way conversations with companies offering services and with their peers — with the goal of winning mindshare and customer loyalty
  • Ability to demonstrate a real-world, live implementation supported by measurable project data and results
  • Multiscreen delivery — the ability to be delivered across multiple screens that feature touch-based, highly responsive controls; rich images; and rapid, anytime access to services

Finalist notification

Entries will be judged between June 20, 2011 and August 18, 2011. Eighteen (18) finalists, three (3) in each category, will be notified by email or telephone the week of August 22, 2011. Finalists will have two days (48 hours) from receipt of notification to acknowledge finalist status and confirm attendance at the event by email. Finalists will be notified that they have been nominated for placement, but they will not know what their winning placement is until the actual event. The sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. If a selected finalist cannot be contacted, is ineligible, fails to acknowledge status, or fails to comply with any term or condition of the official rules, an alternate finalist may be selected. Finalists will be bound by the submission license agreement as a condition of moving forward in the competition and potentially receiving a prize.

2011 MAX Awards Official Rules

Participation in the MAX Awards Contest (the "Contest") constitutes Contestant's full and unconditional agreement to and acceptance of these Official Rules. Contest is sponsored by Adobe Systems Incorporated, 345 Park Ave. San Jose, CA USA 95110 ("Sponsor").

Terms and Conditions

1. Timing

Contest begins Friday, June 3, 2011 and ends at 12 noon Pacific Time on Friday, July 29, 2011. All entries must be uploaded to the competition website no later than 12 noon Pacific Time on Friday, July 29, 2011.

2. Eligibility

Contest is open to all individuals 18 years of age or older. The contest is not open to any resident of the following countries: Cuba, Iran, North Korea, Sudan, and Syria. U.S. export regulations prohibit the export of goods and services to Cuba, Iran, North Korea, Sudan and Syria. Therefore residents of these countries/regions are not eligible to participate.

Employees, officers, and directors of Sponsor, its affiliates, and legal advisors, the judging panel, and the immediate family members and persons living in the same household of such persons are not eligible to participate in the Contest.

Additionally, projects that are funded or sponsored by Adobe or designed specifically for Adobe are not eligible to participate in the Contest. All federal, state, provincial, autonomous, and local laws and regulations apply. Void where prohibited.

3. Categories & Judging

Each entry must meet the requirements, as specified below in Section 4. Any non-conforming entries will be disqualified. Altered, defaced, mutilated, illegible, or incomplete entries are not eligible and will result in disqualification of entry. Entries that contain any content that is pornographic in nature, lewd, or sexually explicit, in Sponsor's sole discretion, will be disqualified. After each entry is screened for compliance with the entry requirements, it will be judged by a panel of judges comprised of Adobe senior management and industry experts. The judges' decisions are final and binding. Judges retain the right to reclassify entries from one category to another or to select only components of the submission for honors. Each of the six (6) categories will have three finalists selected and three honorable mentions awarded, unless the judges determine that the entry quality does not warrant the award of all prizes. Category winners will be selected from the category finalists through online public voting. Adobe reserves the right to not award any Honorable Mentions. The entries, whether submitted by an individual or a group, shall be judged together in each category on a points system based on the judging criteria applicable to all categories:

    • Quality of end-user experience, with an emphasis on experiences that push the boundaries of creative expression, originality, and have an undeniable, universal visual appeal
    • Reach and monetization of application, with proven success at increasing revenue and profitability, opening new revenue channels, and providing customers/audiences with more and newer ways to engage with services and information

    All point calculations will be kept confidential. The categories available for entries are as follows.

    1. Advertising & Branding

      More than ever, brand marketers struggle to break through in today's crowded media environment. Using Adobe solutions, marketers can create engaging advertisements, multi-screen and multi-channel campaigns and rich branded experiences that engage their audiences and create lasting relationships. In this category, we recognize brands that use Adobe technologies to maximize the impact of their brand marketing, from customer engagement to financial returns.

    2. Digital Enterprise: Engaging Customers

      The digital enterprise engaging customers category will recognize an enterprise or government agency who has developed a solution that allows customers to engage through multiple channels. The solution must have demonstrated how they mastered complexities of customer engagements leveraging mobile, social and personalized experiences. In this category, we will look at how business leaders and IT teams worked to build and manage applications that raise an organization's standard of service, reduce costs, and increase revenue through improved engagement. Winning applications will reach across devices and integrate social media strategies to engage broad, diverse audiences. In addition, we'll look for measured returns as organizations acquire and serve people as they order products or access services, manage correspondence, and perform other tasks. Applications must be in production.

    3. Digital Enterprise: Empowering Employees

      The digital enterprise empowering employees category recognizes an organization who have designed a solution for employees to increase productivity and better serve their customers. The solution should demonstrate the use of user experience research to inform application design, and highlight how the application interacts with information and data from back end transaction systems (ERP, CRM, Legacy, etc.) Measurement around employee productivity, process efficiency and improved service to customers will be valued as well as the overall design of the application architecture and user experience.

    4. Digital Publishing

      With dramatic changes in how people access and consume information, publishers are adopting new models to monetize customer engagement and reach increasingly demanding, tech-savvy audiences across devices and channels. Leveraging the latest technologies, editorial and advertising teams are creating, delivering and optimizing content delivered to diverse audiences using popular digital devices. In this category, we want to see how Adobe solutions are used to create and deliver more multimedia-rich digital publishing content across screens, resulting in higher-impact experiences for readers and greater returns for publishers.

    5. Disruptive Design

      Every once in a while an innovation comes along that fundamentally changes the rules around user experience. In this category, we are looking for submissions that showcase emerging customer interactions and strong user-experience breakthroughs delivered electronically and created using one or more Adobe solutions. The key word is innovation--something that transforms what is possible when it comes to user experience and opens new possibilities for businesses and consumers alike. Recent innovations in multi-touch, augmented reality, multiscreen presentations, dynamic layout, community- based creativity and other still-to-be-discovered innovations are characteristic of this category.

    6. Entertainment

      For years, Adobe solutions have been integral to creating and delivering compelling, immersive entertainment experiences. This category will look at how organizations use Adobe solutions to increase the richness and interactivity of every production, as well as expand the reach of entertainment in the multi-screen environment and throughout the online communities in which people participate today. Whether on the movie or television screen, on computers, smartphones, tablets, or other devices, winning submissions will highlight programs, games, or applications that deliver measurable returns, engage audiences via new channels, and push the boundaries of what previously was thought to be possible.

4. How to Enter

  • All entrants must complete the official online form for the 2011 MAX Awards available at http://www.adobemaxsubmission.com/submission. Entries must include a URL to access the submitted work. If the project is not publicly accessible via URL, the project may be submitted via a Web URL with a special Adobe-only login. If selected and a Finalist, you must be able to attend the Adobe MAX 2011 conference and show the project to attendees, including a self-guided demonstration, at the conference.

Each entry MUST:

  • Use at least one product from Adobe in creation of the entry. Projects completed with multiple Adobe products of the most recent version are encouraged;
  • Be in production or in an active pilot stage by the start of MAX 2011 and live and be accessible up to 120 days after the conference;
  • Be an original work and may not contain any plagiarized images, text, or other content;
  • Not contain any pornographic, obscene, defamatory, offensive or other unlawful materials as determined by Sponsor in its sole discretion. Any entry that contains such content will be disqualified;
  • Not be created specifically for or funded by Adobe.
  • Be created or updated after October 27, 2010

Any entry not complying with the above entry requirements will be disqualified and will not be eligible for consideration for any prize. Entries may be submitted for consideration in more than one category but will only be selected as a finalist or other distinction in one (1) category. Each project will only be recognized once. If the same or similar project is submitted by two independent organizations, at Sponsor's sole discretion the project and each organization will be at risk of being disqualified from the contest. Sponsor accepts no responsibility for entries that are lost or damaged in transit. Sponsor shall use reasonable care to prevent any loss or damage to entries received by Sponsor; however, Sponsor shall not be liable for direct, indirect, or consequential loss that results from the loss or damage to any entry.

5. Copyright Ownership

By submitting an entry by a sole creator to a category, contestant represents and warrants that (i) they are the sole designer, creator, and owner of the artwork, including all visual and auditory components, or have permission to use copyrighted components; and (ii) the artwork does not contain any information considered by contestant's place of business or any other third party to be confidential. By submitting an entry by a group of creators, the contestants represent and warrant: (i) that they jointly designed, created, and own the visual and auditory artwork or have permission to use copyrighted components; and (ii) that the artwork does not contain information considered by contestants' place of business or any other third party to be confidential.

6. Prizes

The top three finalists will be selected from each of the six (6) categories ("Finalists") and invited to attend the Adobe MAX 2011 event in Los Angeles, California, USA ("Event"). Each Finalist will receive one complimentary conference registration to the Event and will be featured at the Event. One MAX Award will be granted in each of the six (6) categories to one ("Category Winner") of the top three Finalists in each category as chosen by online public voting. Each Category Winner will be presented with a MAX Award at the Event.

  • Finalist: The top three Finalists will be selected from each of the six (6) categories. Each Finalist will receive one complimentary conference registration to Adobe MAX 2011 and will be featured in the Event, conference, and marketing materials and on Adobe.com. Travel and accommodation expenses are the responsibility of the finalist.
  • Category Winner: One of the top three Finalists will be selected from each of the six (6) categories through online public voting ("Category Winner"). Each Category Winner will be presented with a MAX Award trophy at the Event, recognized in conference and marketing materials and on Adobe.com, and be included in an Adobe issued press release announcing the winners.
  • Honorable Mention: Three (3) projects will be selected in each of the six (6) categories as Honorable Mentions. Each Honorable Mention will be listed on Adobe.com, along with a logo and short description of the project. In addition, Honorable Mentions may be featured in the Event, conference, and marketing materials and on Adobe.com. Adobe reserves the right to not award any Honorable Mentions.

Because this is a contest of skill, winning is dependent upon the quality of entries received. All prizes will be awarded unless there are fewer eligible entries for a Category than prizes for that Category or the judges determine that the quality of entries does not warrant a prize. No alternative prize, cash, or other substitution is allowed except by Sponsor in the event of prize unavailability. Prizes are non-assignable/non-transferable. All federal, state, provincial, and local taxes are the sole responsibility of the winners.

7. Finalist Notification

Finalists will be bound by the submission license agreement, presented and agreed to during contest registration, as a condition of moving forward in the competition and potentially receiving a prize, Finalists may be asked to physically sign the submission agreement in order to proceed in the contest. The text of the previously agreed to submission agreement is as follows:

Each Contestant agrees that by submitting a 2011 MAX Award entry:

  • He or she willingly grants a limited license to Adobe (and its authorized agents acting on behalf of Adobe in connection with the Adobe MAX Conference and Awards), to use, reproduce, publicly perform and display, and distribute the materials included in your submission for the marketing and promotion of Adobe, its products and services, in each case solely in connection with the Adobe MAX Conference and MAX Awards. This license is nonexclusive, worldwide, royalty-free, and fully paid. You will retain ownership of the Materials.

8. General Terms and Conditions

Sponsor is not responsible for and shall not be liable for:

(i) lost, late, delayed, damaged, incomplete, illegible, unintelligible, or misdirected entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind (iii) failed, incomplete, partial, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of a prize, or acceptance, possession, or use of a prize, or from participation in the Contest; (vi) any printing or typographical errors in any materials associated with the Contest (not applicable in Spain); (vii) any regional, state, autonomous, or local laws or regulations violated during the creation of the entries by the Contestant(s). Sponsor reserves the right to suspend, cancel, or modify the Contest if fraud or technical failure corrupts the administration, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. Each Contestant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based upon intellectual property infringement, publicity rights, defamation, or invasion of privacy. Notwithstanding the foregoing, the preceding release of liability will not apply with respect to personal injury, death, or damage to property caused by Sponsor negligence against Contestants residing in India and will not apply with respect to personal injury or death caused by Sponsor negligence against Contestants residing in Hong Kong or Portugal. The preceding release of liability only applies to ordinary or minor negligence caused by Sponsor against Contestants residing in Spain. Each Contestant agrees that Sponsor's only obligation is to submit entries from eligible Contestants to the judges according to the procedures and criteria set forth in these Official Rules, and award the prizes set forth herein to winners, subject to the terms and conditions herein. Contestant agrees that Sponsor's obligation is fair and adequate consideration for any entry submitted, and that Contestant is not entitled to and shall not seek any further compensation.

Each Contestant agrees that if his or her entry is selected as a winning entry, as a condition of receiving a prize, Contestant shall sign a license agreement granting to Sponsor a royalty-free, non-exclusive, perpetual, worldwide license to use, reproduce, distribute, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying, and prepare derivative works based upon winner's entry, for the purposes of advertising and promoting Adobe products, and for inclusion in and distribution with Adobe products. To the extent that such a perpetual license is ineffective or unenforceable, Contestant shall sign a license agreement providing to Sponsor a royalty-free, non-exclusive, two-year (2), worldwide license to use, reproduce, distribute, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying, and prepare derivative works based upon winner's 2011 MAX Award entry, for the purposes of advertising and promoting Adobe products, and for inclusion in and distribution with Adobe products. Each Contestant further agrees to execute any and all documents necessary to effectuate such license.

Each Contestant agrees that by submitting a 2011 MAX Award entry, He or she allows the use of his or her personal data, name, likeness, and/or voice in publicity or advertising relating to the Contest without compensation. Except for issues affecting Contestants residing in Portugal or Spain, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Contestant and Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California. Where permitted by law, Contestant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California (San Jose Division) or the appropriate California State Court located in Santa Clara County, California.

Règlement officiel du concours MAX Awards 2011

La participation au concours MAX Awards (ci-après dénommé « le Concours ») vaut pleine et entière acceptation du présent règlement officiel par le candidat. Le Concours est organisé et parrainé par Adobe Systems Incorporated, 345 Park Avenue, San Jose, CA 95110-2704, États-Unis (ci-après dénommé « l'Organisateur »).

Conditions générales

1. Calendrier

Le Concours débute le vendredi 3 juin 2011 et se termine le vendredi 29 juillet 2011 à 12 heures (midi), heure du Pacifique. Tous les projets doivent être déposés sur le site web du Concours au plus tard le vendredi 29 juillet 2011 à 12 heures (midi), heure du Pacifique.

2. Conditions de participation

Le Concours est ouvert à toute personne âgée d'au moins 18 ans. Le Concours n'est pas ouvert aux résidents des pays suivants : Cuba, Iran, Corée du Nord, Soudan et Syrie. Les réglementations américaines interdisant l'exportation de biens et de services vers Cuba, l'Iran, la Corée du Nord, le Soudan et la Syrie, les résidents de ces pays ne sont pas autorisés à participer au Concours.

Ne sont pas autorisés à participer au Concours les salariés, cadres et dirigeants de l'Organisateur et de ses sociétés affiliées, les conseillers juridiques, membres du jury, ainsi que la famille proche ou les individus vivant sous le même toit que toutes ces personnes.

De plus, les projets financés ou parrainés par Adobe, ou spécialement conçus pour Adobe, ne peuvent être présentés au Concours. Le Concours est soumis à toutes les lois des différents pays, États, provinces et régions autonomes. Offre déclarée nulle dans les pays où elle fait l'objet d'une interdiction.

3. Catégories et évaluation

Chaque dossier doit répondre aux conditions spécifiées au Paragraphe 4 sous peine d’être disqualifié. Les dossiers endommagés, raturés, illisibles, non conformes ou incomplets ne seront pas pris en compte et entraîneront le rejet de la candidature. Les projets dont le contenu présente un caractère pornographique, obscène ou sexuellement explicite, selon des critères laissés à la seule discrétion de l'Organisateur, seront disqualifiés. Une fois jugé recevable, chaque projet sera examiné par un jury composé d'experts métier et de dirigeants d'Adobe. Les décisions des juges sont définitives et exécutoires. Le jury se réserve le droit de classer un dossier dans une autre catégorie ou de n’en retenir qu’une partie pour l’attribution des prix. Dans chacune des six (6) catégories, trois finalistes seront désignés et trois mentions honorables seront décernées, à moins que le jury estime que la qualité des projets présentés ne justifie pas l'attribution des trois prix. Les lauréats des différentes catégories seront ensuite désignés par un vote public en ligne. Adobe se réserve le droit de ne décerner aucune mention honorable. Qu’ils soient soumis à titre individuel ou collectif, les projets seront jugés ensemble dans chaque catégorie selon un barème de points basé sur des critères applicables à toutes les catégories :

  • Qualité de l'expérience utilisateur, l'accent étant mis sur les contenus qui repoussent les limites de la créativité et de l'originalité et dont l'impact visuel indéniable est résolument universel
  • Portée et monétisation de l'application, avec augmention avérée du chiffre d'affaires et de la rentabilité, identification de nouvelles sources de revenus et création de nouveaux modes d'interaction entre les clients/le public et les services et informations
  • Nombre de solutions Adobe utilisées
  • Capacité de l'application à capter le public sur différents canaux, tels que les réseaux sociaux, et à permettre une communication bidirectionnelle entre le public, d'une part, et ses pairs ou les prestataires, d'autre part — dans le but de gagner en notoriété et de fidéliser la clientèle
  • Démonstration d'implémentations concrètes illustrées par des données et résultats de projet quantifiables
  • Affichage sur écrans multiples : l'application doit être diffusée sur divers types d'écran offrant des commandes tactiles très réactives, des images sophistiquées ainsi qu'un accès rapide aux services, à tout moment

Tous les calculs de points demeureront confidentiels. Les catégories du Concours sont les suivantes :

  1. Publicité et valorisation de marque

    Pour se démarquer dans l'environnement multimédia actuel, les spécialistes du marketing des marques doivent mener une lutte acharnée. Avec les solutions Adobe, ces spécialistes peuvent créer des publicités attrayantes, des campagnes multi-écrans et multicanaux, ainsi que de riches expériences personnalisées permettant d'interagir avec le public et de le fidéliser. Cette catégorie met à l'honneur les marques qui font appel aux technologies Adobe pour maximiser l'impact de leur marketing de marque, depuis la communication avec le client jusqu'aux retours sur investissement.

  2. Entreprise numérique : interagir avec les clients

    Cette catégorie vise à récompenser une entreprise ou une administration ayant développé une solution qui permet aux clients ou administrés de communiquer via de multiples canaux. La solution devra démontrer comment l'entité a surmonté les difficultés inhérentes aux communications basées sur les contenus mobiles, sociaux et personnalisés. Nous nous pencherons, dans cette catégorie, sur la façon dont les dirigeants et les équipes informatiques auront élaboré et géré des applications qui élèvent le niveau des prestations, réduisent les coûts et augmentent les revenus grâce à de meilleures interactions. Nous récompenserons les applications qui permettent de communiquer sur l'ensemble des équipements et qui intègrent les stratégies des médias sociaux pour séduire un public large et varié. Nous rechercherons en outre des retours sur investissements quantifiés dans la façon dont les entités gagnent des clients/administrés et répondent à leurs besoins lors des passations de commandes, des accès aux services, de la gestion de la correspondance, etc. Les applications doivent être en phase de production.

  3. Entreprise numérique : optimiser le travail des employés

    Cette catégorie récompensera l'entreprise ou l'administration qui aura conçu une solution permettant d'améliorer la productivité des employés et les prestations aux clients/administrés. La solution doit démontrer que l'application a été précédée de recherches sur l'expérience utilisateur. Elle doit également souligner la façon dont l'application interagit avec les informations et les données issues des systèmes transactionnels back-end (systèmes ERP, CRM, hérités, etc.). La productivité des employés, l'efficacité des processus et l'amélioration des prestations fournies aux clients/administrés seront évaluées, tout comme la conception globale de l'architecture de l'application et de l'expérience utilisateur.

  4. Publication numérique

    Les modes d'accès aux informations et leur utilisation ont tellement évolué que les éditeurs adoptent de nouveaux modèles pour monétiser les échanges avec la clientèle et s'adresser à un public féru de technologie et de plus en plus exigeant sur l'ensemble des canaux et terminaux. En exploitant les toutes dernières technologies, les équipes éditoriales et publicitaires créent, diffusent et optimisent du contenu pour différents publics via les terminaux numériques les plus répandus. Dans cette catégorie, nous souhaitons étudier comment les solutions Adobe permettent de créer et diffuser du contenu numérique multimédia sur tous les écrans, et de générer ainsi des expériences de lecture à plus fort impact et des retours sur investissement plus conséquents pour les éditeurs.

  5. Audace

    Il arrive qu'une innovation vienne bouleverser la donne en matière d'expérience utilisateur. Dans cette catégorie, nous recherchons les projets électroniques qui innovent radicalement en matière d'expérience utilisateur et d'interaction avec le client. Ces projets peuvent faire appel à une ou plusieurs solutions Adobe. Le maître mot est l'innovation —vous devez repousser les limites de l'expérience utilisateur et ouvrir de nouvelles perspectives pour les entreprises comme pour les particuliers. Cette catégorie vise donc, par exemple, les dernières innovations apparues dans des domaines tels que la technologie tactile, la réalité augmentée, les présentations multi-écrans, la mise en pages dynamique et la créativité communautaire.

  6. Divertissement

    Depuis des années, les solutions Adobe font partie intégrante des processus de création et de diffusion de contenus de divertissement engageants et captivants. Dans cette catégorie, nous examinerons comment les entreprises ou administrations tirent parti des solutions Adobe pour améliorer la richesse et l'interactivité de chaque production, et étendre la portée du divertissement dans l'environnement multi-écran et dans toutes les communautés en ligne actuelles. Quels que soient les supports (cinéma, téléviseurs, ordinateurs, smartphones, tablettes et autres terminaux mobiles), les candidats devront privilégier des programmes, jeux ou applications qui génèrent des retours quantifiables, captent l'attention du public via de nouveaux canaux et repoussent les limites du possible.

4. Modalités d'inscription

  • Tous les candidats doivent remplir le formulaire officiel en ligne du concours MAX 2011, disponible à l’adresse suivante : http://www.adobemaxsubmission.com/submission. Les candidats doivent indiquer une URL donnant accès au projet soumis. Si le projet n'est pas accessible via une URL, il pourra être soumis via l'URL d'une page web avec un identifiant Adobe spécial. Si vous êtes sélectionné parmi les finalistes, vous devez assister à la conférence Adobe MAX 2011 et présenter votre projet aux autres participants, avec une démonstration autoguidée.

Conditions OBLIGATOIRES pour chaque projet :

  • Le projet soumis doit être créé en utilisant au moins un produit Adobe. Nous privilégions les projets réalisés avec les versions les plus récentes de plusieurs produits Adobe.
  • Votre projet doit se trouver en phase de production ou dans une phase pilote active au début de la conférence MAX 2011, puis être opérationnel et accessible pendant 120 jours après la clôture de la conférence.
  • Il doit s'agir d'un projet original, ne contenant aucun contenu plagié (texte, images, etc.).
  • Le projet doit être exempt de tout contenu pornographique, obscène, diffamatoire, offensant ou autrement contraire à la loi, selon des critères laissés à la seule discrétion de l'Organisateur. Les projets comportant de tels contenus seront disqualifiés.
  • Le projet ne doit pas être spécialement créé pour Adobe ou financé par l’éditeur.
  • Le projet doit avoir été créé ou mis à jour après le 27 octobre 2010

Les projets ne remplissant pas les conditions énoncées ci-dessus seront disqualifiés et ne pourront prétendre à aucune récompense. Un dossier peut être soumis dans plusieurs catégories, mais ne peut être finaliste ou faire l’objet d’une autre distinction que dans une (1) catégorie. Chaque projet ne peut être récompensé qu’une seule fois. Si deux établissements indépendants soumettent des projets identiques ou similaires, l'Organisateur se réserve le droit de les disqualifier. L'Organisateur décline toute responsabilité quant aux dossiers perdus ou endommagés pendant l'envoi. L'Organisateur prendra toutes les précautions nécessaires pour éviter toute perte ou détérioration des dossiers reçus, mais ne pourra être tenu responsable d'une perte directe, indirecte ou consécutive résultant d'un incident ou d'un dommage.

5. Droits d'auteur et propriété intellectuelle

En remettant un projet individuel dans une catégorie, le participant déclare et certifie (i) qu’il est le seul et unique concepteur, créateur et propriétaire de l’œuvre, y compris des composants visuels et sonores, ou qu'il est autorisé à utiliser les composants soumis à droits d’auteur, et (ii) que l’œuvre ne contient aucune information considérée comme confidentielle sur son lieu d’activité ou par toute autre partie tierce. En remettant un travail collectif, les membres du groupe déclarent et certifient (i) qu’ils l’ont conçu et créé conjointement, qu’ils sont propriétaires des éléments visuels et sonores, ou qu’ils sont autorisés à utiliser les composants soumis à droits d’auteur, et (ii) que l’œuvre ne contient aucune information considérée comme confidentielle sur leur lieu d’activité ou par toute autre partie tierce.

6. Lots

Trois finalistes seront désignés dans chacune des six (6) catégories (ci-après dénommés « les Finalistes ») et invités à participer à la conférence Adobe Max 2011 de Los Angeles aux États-Unis (ci-après dénommée « l'Événement »). Chaque Finaliste recevra un formulaire d'inscription à l'Événement, où il sera présenté. Dans chacune des six (6) catégories, un prix MAX sera décerné à l'un des trois Finalistes (ci-après dénommé « le Lauréat de sa catégorie ») au terme d'un vote public en ligne. Chaque Lauréat de sa catégorie se verra remettre un prix MAX lors de l’Événement.

  • Finaliste : Trois Finalistes seront désignés dans chacune des six (6) catégories. Chaque Finaliste recevra un formulaire d'inscription à Adobe MAX 2011 et sera présenté dans les supports marketing, à la conférence et lors de l'Événement ainsi que sur Adobe.com. Les frais de déplacement et d'hébergement engagés pour participer à l'Événement seront à la charge du Finaliste.
  • Lauréat de sa catégorie : Un lauréat sera désigné dans chacune des six (6) catégories (ci-après dénommé « le Lauréat de sa catégorie ») au terme d'un vote public en ligne. Chaque Lauréat de sa catégorie se verra remettre un trophée MAX lors de l’Événement, sera présenté à la conférence, dans les supports marketing et sur Adobe.com, et sera cité dans un communiqué de presse d’Adobe annonçant les lauréats.
  • Mention honorable : Des mentions honorables seront décernées à trois (3) projets sélectionnés dans chacune des six (6) catégories. Chaque mention honorable sera citée sur Adobe.com, accompagnée d’un logo et d’une brève description du projet. Les mentions honorables pourront également être mentionnées dans les supports marketing, lors la conférence, de l'Événement et sur Adobe.com. Adobe se réserve le droit de ne décerner aucune mention honorable.

Ce Concours ayant pour but de valider des compétences, les prix dépendent de la qualité des projets reçus. Tous les prix seront attribués sauf si le nombre de projets recevables dans une catégorie est inférieur au nombre de prix prévu, ou si le jury décide que la qualité des projets ne justifie pas un prix. Aucun prix de remplacement et aucune somme d’argent ou autre ne sont autorisés, sauf si l’Organisateur en décide autrement en cas d’indisponibilité des prix. Les prix ne sont ni cessibles ni transférables. Les taxes éventuelles propres aux différents pays, États ou provinces sont à la charge des lauréats.

7. Notification aux finalistes

Les projets seront évalués entre le 20 juin et le 18 août 2011. Les dix-huit (18) finalistes, trois dans chaque catégorie, seront avertis par courrier électronique ou téléphone dans la semaine du 22 août 2011.

Les finalistes disposeront alors de deux jours (48 heurs) à compter de cette date pour accuser réception de la notification et confirmer leur participation à l'Événement par courrier électronique. Les Finalistes sauront qu'ils sont nominés mais ne connaîtront pas leur classement exact avant la Remise des prix. L'Organisateur ne saurait être tenu responsable d'un retard, d'une perte, d'une erreur d'acheminement ou d'une non-remise de la notification aux lauréats. Si un Finaliste sélectionné ne peut être averti, ne remplit pas les conditions de participation, n’accuse pas réception de la notification de sélection ou ne se conforme pas à l’une des clauses du présent Règlement officiel, un autre Finaliste peut être sélectionné à sa place. Les Finalistes seront soumis à un contrat de licence dont les termes seront présentés et acceptés lors de l'inscription au Concours. Ils pourront être invités à apposer leur signature manuscrite sur ledit contrat, comme condition de leur participation effective au Concours. Voici les termes du contrat :

Chaque participant reconnaît qu'en soumettant un projet au concours MAX Awards 2011 :

  • il octroie à Adobe (et à tous ses représentants agréés agissant en son nom dans le cadre du salon et du concours Adobe MAX) une licence limitée pour utiliser, reproduire, diffuser et afficher dans les lieux publics et distribuer les supports du projet pour la promotion d'Adobe et de ses produits et services, à condition que ce soit en rapport avec la conférence et le concours Adobe MAX. Cette licence est non exclusive, internationale, libre de droits et payée dans sa totalité. Le participant demeure le propriétaire des Supports.

8. Conditions générales

L’Organisateur ne saurait être tenu responsable des événements suivants :

(i) dossiers perdus, en retard, différés, endommagés, incomplets, illisibles, incompréhensibles ou mal acheminés ; (ii) dysfonctionnements, pannes ou problèmes liés aux équipements téléphoniques, appareils électroniques, matériel/logiciels informatiques, au réseau ou à Internet ; (iii) échecs ou retards des transmissions informatiques, transmissions incomplètes, altérées ou partielles ; (iv) toute condition provoquée par des événements indépendants de la volonté de l’Organisateur, qui aurait pour conséquence de dénaturer ou perturber le Concours ; (v) blessures, pertes ou dommages de toutes sortes liés ou faisant suite à un prix ou bien à l'acceptation, la possession ou l'utilisation d'un prix, ou découlant de la participation au Concours ; (vi) erreurs d’impression ou de typographie dans les documents et supports associés au Concours (non applicable en Espagne) ; (vii) violation des lois ou réglementations d'un pays, d'un État, d'une province ou d'une région autonome lors de l’élaboration des dossiers par le(s) participant(s). L’Organisateur se réserve le droit de suspendre, d’annuler ou de modifier le Concours si une fraude ou une erreur technique en perturbe l’administration, la sécurité ou le déroulement, selon des critères laissés à sa seule discrétion. Chaque participant accepte de dégager l’Organisateur de toute responsabilité quant aux pertes, dommages, droits, réclamations et actions de toute nature liés au Concours et résultant de l’acceptation, la possession ou l’utilisation d’un prix, y compris et sans limitation, les blessures, le décès, les dommages matériels et les plaintes concernant la violation de la propriété intellectuelle, les droits publicitaires, la diffamation ou l’atteinte à la vie privée. Nonobstant ce qui précède, les candidats résidant en Inde ne sont pas assujettis aux parties de la décharge de responsabilité ci-dessus relatives aux blessures, au décès ou aux dommages matériels résultant d'une négligence de l'Organisateur. Les candidats résidant à Hong-Kong ou au Portugal ne le sont pas non plus en ce qui concerne les blessures ou décès résultant d'une négligence de l'Organisateur. La décharge de responsabilité qui précède vaut uniquement pour des fautes légères commises par l'Organisateur à l'encontre de candidats résidant en Espagne. Chaque participant admet que la seule obligation de l’Organisateur est de soumettre au jury les dossiers des participants dont la candidature est recevable selon les procédures et critères définis dans le Règlement officiel, et de remettre les prix aux lauréats, selon les présentes conditions générales. Le participant reconnaît que l’Organisateur a un devoir d’équité vis-à-vis de tous les dossiers soumis et que le participant n'a droit à aucune indemnité et renonce à toute réclamation en ce sens.

Chaque participant reconnaît que si son travail est sélectionné pour un prix, il devra, pour recevoir ce dernier, signer un contrat accordant à l'Organisateur une licence perpétuelle, hors droits d'auteur, mondiale et non exclusive pour utiliser, reproduire et distribuer les œuvres primées, ou les diffuser ou les afficher dans des lieux publics, les modifier en vue de leur diffusion ou leur affichage publics, en créer des dérivés pour la promotion ou la publicité des produits Adobe, et les fournir avec les produits Adobe. Si tant est que cette licence perpétuelle soit inopérante ou inapplicable, le participant signera un contrat accordant à l'Organisateur une licence mondiale de deux (2) ans non exclusive, hors droits d’auteur, pour utiliser, reproduire et distribuer les œuvres primées au concours MAX 2011, ou les diffuser ou les afficher dans des lieux publics, les modifier en vue de leur diffusion ou leur affichage public, en créer des dérivés pour la promotion ou la publicité des produits Adobe, et les fournir avec les produits Adobe. Chaque participant accepte en outre de valider tout document nécessaire à l’application d’une telle licence.

Chaque participant reconnaît qu'en soumettant un projet au concours MAX 2011, il autorise l'utilisation de ses données personnelles, de son nom, de son image et/ou de sa voix dans les publicités et communications relatives au Concours, sans dédommagement ni rétribution. Lorsque la législation l'y autorise, le participant accepte que tout ou partie des litiges, revendications, droits de poursuite découlant du présent concours ou en rapport avec lui, ou avec les prix décernés, autres que l'administration de ce Concours ou le choix des lauréats, soient résolus individuellement, sans recourir à une action collective, et exclusivement par le tribunal de première instance du district nord de la Californie (San Jose Division) ou le tribunal de l'État de Californie compétent du comté de Santa Clara.

2011 MAX Awards公式規定

MAX Awards Contest(以下「コンテスト」という)への参加は、すなわち本公式規定に完全かつ無条件に同意し受諾することを意味します。コンテストは、Adobe Systems Incorporated(アドビ システムズ社)345 Park Ave. San Jose, CA USA 95110(以下「主催者」という)が主催します。

諸条件

1. 時期

コンテストの募集期間は、2011年6月3日(金曜日)から、2011年7月29日(金曜日)正午12:00(太平洋標準時)までとし、この時間に応募用Webサイトにアップロードが完了している応募のみを有効とします。

2. 応募資格

18歳以上の個人であること。ただし、キューバ、イラン、北朝鮮、スーダン、およびシリアの居住者は対象外とします。アメリカの輸出規制により、キューバ、イラン、北朝鮮、スーダン、およびシリアへの製品およびサービスの輸出が禁じられているため、これらの国および地域の居住者には応募資格がありません。

主催者、その関連会社および顧問法律事務所の従業員、管理職および役員、当コンテストの審査員、ならびにこれらの家族および同居者には、コンテストへの参加資格がないものとします。

これに加え、アドビ システムズ社の後援または資金提供によるプロジェクト、およびアドビ システムズ社専用に作成されたデザインは、コンテストへの応募資格がないものとします。応募には、国、州、郡および地域のすべての法律および規制が適用されます。これらに違反する応募は無効となります。

3. カテゴリーおよび審査

  • すべての応募は、後述の第4条で定める必要条件を満たしていなければなりません。条件を満たさない応募はすべて失格とします。改ざん、汚破損、判読できない箇所、記入の不備などのある応募は受け付けず、失格とします。猥褻または性的な表現を明らかに含む応募作品は、主催者独自の判断により失格とすることができます。すべての応募は、応募要項を満たしていることの確認を終えた後、主催者の経営陣および業界の専門家で構成される第三者審査員団により審査されます。審査員の決定は最終的であり、拘束力を有します。審査員は、応募カテゴリーを変更したり、応募作品の一部を選んで受賞対象とする権限を有します。審査の結果、6つのカテゴリーのそれぞれにおいて最終候補者3名を選定し、別の3名に選外佳作を与えます。ただし、これらの賞に該当する応募作品なしと審査員が判断した場合はこの限りではありません。さらに、各カテゴリーの最終候補者の中からカテゴリー賞受賞者をオンライン投票によって選出します。主催者は、選外佳作の授与を却下する権利を有します。応募作品は、個人エントリー・グループエントリーの区別なく、全カテゴリーを対象とする以下の審査基準に基づいて、カテゴリーごとにポイント制で審査します。
  • エンドユーザー体験の質(これまでにない表現手法を用い、独創的で、ユニバーサルな視覚的訴求力を持つこと)
  • アプリケーションの利用対象者の広範さと収益性の実証(収入および収益性の拡大、新たな収益チャネルの実現、サービスおよび情報へのアクセスに関してより多くの新しい方法が顧客・ユーザーに提供されること)
  • アプリケーションの開発に使用するアドビソリューションの幅広さ
  • ソーシャルメディアなどの多様なチャネルを通じてユーザーを引き付け、サービス提供企業や関連企業との双方向の対話へのユーザー参加を促し、マインドシェアと顧客ロイヤルティの獲得につなげるアプリケーション機能
  • 測定可能なプロジェクトデータおよび成果によって説明される実装の実例
  • マルチスクリーンでのアプリケーション提供(応答性の高いタッチベースのコントロールとリッチな画像を備えたアプリケーションを複数のデバイスで提供し、サービスへの高速アクセスが随時可能であること)

ポイントの計算方法は全て非公開とします。応募可能なカテゴリーは以下のとおりです。

  1. 広告・ブランド部門

    今日の複雑なメディア環境の中で、マーケティング担当者は自社のブランドに目を引き付けるためにこれまで以上に奮闘しています。アドビソリューションの活用により、マーケティング担当者は人目を引く広告、マルチスクリーン・マルチチャネルのキャンペーン、魅力的なブランド体験を制作し、ユーザーを引き付け、長期的な関係を築くことができます。このカテゴリーでは、アドビテクノロジを活用して自社のブランドマーケティングのインパクトを最大化し、顧客エンゲージメントを収益に結び付けているブランドを評価します。

  2. デジタル企業:顧客エンゲージメント

    「デジタル企業:顧客エンゲージメント」カテゴリーでは、顧客が多様なチャネルを通じて利用可能なソリューションを開発した企業または行政機関を評価します。対象となるソリューションは、モバイル、ソーシャルネットワーク、その他の個別システムを通じてユーザー体験を提供することで生じる顧客エンゲージメントの複雑さを克服している必要があります。このカテゴリーでは、顧客エンゲージメントの強化によって、組織のサービス基準を引き上げ、コストを削減し、収益を拡大するアプリケーションの構築・管理における、組織のリーダーとITチームの取り組みに着目します。幅広いデバイスに対応し、ソーシャルメディア戦略を統合して多様なユーザーの顧客エンゲージメントを獲得したアプリケーションが受賞の対象となります。さらに、製品の注文、サービスへのアクセス、通信の管理、およびその他の業務において、組織が顧客を獲得し、サービスを提供することで得られた利益の実績にも着目します。アプリケーションが実際に稼働中であることが必要です。

  3. デジタル企業:従業員支援

    「デジタル企業:従業員支援」カテゴリーでは、生産性と顧客サービスの向上を目的とする従業員向けのソリューションを設計した組織を評価します。対象となるソリューションは、ユーザー体験に関する調査がアプリケーションの設計に活用され、アプリケーションとバックエンドトランザクションシステム(ERP、CRM、Legacyなど)との情報・データの連携に優れていることが必要です。従業員の生産性、プロセスの効率性、顧客サービスの向上の測定結果と共に、アプリケーションアーキテクチャおよびユーザー体験の総合的な設計についても着目します。

  4. デジタルパブリッシング部門

    人と情報とのアクセスや消費の方法が急激に変化する中、出版社では、顧客エンゲージメントを収益に結び付け、ますます多くを求め技術に精通するユーザーに広範なデバイスとチャンネルを通じて対応する、新しいモデルを採用しつつあります。編集および広告チームは最新のテクノロジを活用し、人気のデジタルデバイスを通じて多様なユーザーに配信されるコンテンツを制作、配信、最適化しています。このカテゴリーでは、広範なデバイス向けによりマルチメディアリッチなデジタル配信コンテンツを作成・提供して、読者に強いインパクトを与え、出版社の利益拡大をもたらしたアドビソリューション活用例を募集します。

  5. 破壊を起こすデザイン部門

    革新的アイデアはユーザー体験に関する基準に根本的な変化が起こる際に現れることがままあります。このカテゴリーでは、斬新なカスタマーインタラクションや力強いユーザー体験を提供する、1つ以上のアドビソリューションを利用して制作された電子的に配信される作品を募集します。キーワードは「innovation」です。ユーザー体験を変革するような何か、またビジネスやコンシューマーにおいても新しい可能性を秘めたアイデアです。マルチタッチ、拡張現実、マルチスクリーンプレゼンテーション、ダイナミックレイアウト、コミュニティベースの創造やまだ認知されていない新しいアイデアなどがこのカテゴリーに当てはまります。

  6. エンターテイメント部門

    長年にわたり、アドビソリューションは、ユーザーを魅了し夢中にさせるエンターテイメント体験の作成・提供に不可欠な存在となっています。このカテゴリーでは、すべての制作物をよりリッチでインタラクティブなものとし、マルチスクリーン環境および今日人々が参加しているオンラインコミュニティにおいて、エンターテインメントの利用者を拡大するための、組織でのアドビソリューション活用法に着目します。映画、テレビ、コンピューター、スマートフォン、タブレット、その他のデバイスなどメディアを問わず、測定可能な利益をもたらし、新しいチャンネルを通じてユーザーを夢中にさせる、これまでの想像を超えたプログラムやゲーム、アプリケーションが受賞の対象となります。

4. 応募方法

  • 応募はすべて、2011 MAX Awards応募専用のオンラインフォームに記入して行ってください。応募フォームは、http://www.adobemaxsubmission.com/submissionから入手できます。応募フォームには応募作品にアクセスできるURLを明記してください。一般のURLからアクセスできないプロジェクトの場合は、主催者だけが特別にログイン可能なWeb URLを使用して応募してください。最終候補者として選定された場合、Adobe MAX 2011カンファレンスに出席し、説明者なしで視聴可能なデモを含め、他の出席者にプロジェクトを展示できる必要があります。

応募に際しては、次の条件が必須となります。

  • 応募作品の制作に1つ以上のアドビ製品を使用していること。アドビ製品の最新バージョンを複数使用したものが望ましい。
  • MAX 2011の開始以前に稼動中または実際の試用段階に入っており、カンファレンス以後120日間も同様に有効かつアクセス可能であること。
  • 制作品がオリジナルであり、含まれる画像、テキスト、および他のコンテンツが盗用したものでないこと。
  • 猥雑、中傷的、不快感を催すと主催者独自が判断するような内容を含まないこと。このような内容が含まれる応募はすべて失格とします。
  • 主催者専用に、または主催者の資金援助を受けて制作したものでないこと。
  • 2010年10月27日以降に作成または更新されたものであること。

上記の応募条件に従わない応募はすべて失格とし、審査および受賞の対象外となります。作品を2つ以上のカテゴリーに応募することは可能ですが、作品が最終候補または他の受賞候補に選定されるのは1つのカテゴリーにおいてのみです。各プロジェクにつき、入選は一度のみです。2つの独立組織が同一もしくは類似のプロジェクトを応募した場合、そのプロジェクトおよび各組織は、主催者独自の判断でコンテスト失格となることがあります。応募作品の配送中に発生した紛失または破損について、主催者はいっさい責任を負いません。主催者は、受理した応募作品に対し、紛失または破損を防ぐための相当の注意を払います。ただし、主催者は作品の紛失または破損に起因する直接的、間接的または派生的損失に対する責任を負いません。

5. 著作権の帰属

あるカテゴリーに作品を応募した制作者が1人の場合、そのコンテスト参加者は以下を保証するものとします。(i) 応募することをもって自らが視覚・聴覚的構成素材を含む作品を単独でデザイン・制作して所有しているか、または著作権のある構成素材の使用許諾を得ていること。(ii) その作品にコンテスト参加者の所属先、その他の第三者において機密とされている情報がいっさい含まれていないこと。あるカテゴリーに作品を応募した制作者が複数の場合、そのコンテスト参加者は以下を保証するものとします。(i) 自分たちが視覚・聴覚的構成素材を含む芸術作品を合同でデザイン・制作して所有しているか、または著作権のある構成素材の使用許諾を得ていること。(ii) その作品にコンテスト参加者らの所属先、その他の第三者において機密とされている情報がいっさい含まれていないこと。

6. 賞

6つのカテゴリーで上位各3名(以下「最終候補者」という)を選定し、米国カリフォルニア州ロサンゼルスで開催するAdobe Max 2011イベント(以下「イベント」という)に招待します。各最終候補者には1名分のイベントへの参加資格を授与し、イベントで正式に紹介します。6つのカテゴリーで選定された最終候補者各3名の内、オンライン投票によって選出された1名(以下「カテゴリー賞受賞者」という)に「MAX Award(MAX賞)」を授与します。各カテゴリー賞受賞者には、イベントでMAX Awardを贈呈します。

  • 最終候補者:6つの各カテゴリーで上位3名の最終候補者を選定します。各最終候補者にはAdobe MAX 2011への1名分の参加資格を授与するとともに、イベント、カンファレンス、マーケティング媒体、およびAdobe.comで正式に紹介します。旅費および宿泊費は、最終候補者が負担するものとします。
  • カテゴリー賞受賞者:6つのカテゴリーで選定された各3名の最終候補者の中から、オンライン投票によって1名(「カテゴリー賞受賞者」)を選びます。カテゴリー賞受賞者にはイベントでMAX Awardトロフィーを贈呈し、カンファレンス、マーケティング媒体、およびAdobe.comで正式に紹介します。また、アドビ発行のプレスリリースでも受賞者として発表します。
  • 選外佳作:6つのカテゴリーで各3点の選外佳作を選定します。選外佳作のプロジェクトは、ロゴおよびプロジェクト概要とともに、Adobe.comに掲載します。これに加え、選外佳作をイベント、カンファレンス、マーケット媒体、およびAdobe.comで正式に紹介する場合もあります。主催者は、選外佳作の授与を却下する権利を有します。

本コンテストは技術を競い合うものであるため、受賞の有無は応募作品の質に左右されます。賞品は、有効な応募数がカテゴリーの賞数に達しなかった場合、または審査員が受賞レベルに達する該当作品なしと決定した場合を除き、すべて授与するものとします。賞品が入手不可能な場合に主催者が認めない限り、別の賞品、賞金、またはその他の代替品の授与は許可しません。賞品を他人に譲渡したり移譲したりすることはできません。国、州、郡および地域の税金については、受賞者自身がこれを負担するものとします。

7. 最終候補者への通知

応募作品の選考は、2011年6月20日から8月18日の間に行います。計18名の最終候補者は、Eメールまたは電話を通じて2011年8月22日の週に通知を受けるものとします。

最終候補者は、通知の受領から2日(48時間)の期間中に、最終候補者であることの承認と、イベント出席の確約をEメールで通知しなければなりません。最終候補者には最終審査に残った旨は通知しますが、実際のイベントまでに順位を知らせることはありません。主催者は、最終候補者への通知に際して発生した遅延、紛失、宛名違い、または努力を行ったにもかかわらず結果を通知できなかった場合の責任を負うことはありません。選定した最終候補者に連絡が取れない場合、候補者が不適格である場合、候補者であることを承認しなかった場合、または本公式規定の条件に従わなかった場合は、代わりの最終候補者を選定することができます。最終候補者は、勝ち進んで受賞する可能性があることを条件として、コンテスト応募手続き時に提示および同意された応募作品の使用許諾契約に拘束されるものとし、コンテストに参加するために、その契約への署名を求められることがあります。これまでに同意された応募作品の契約書の本文は以下のとおりです。

すべてのコンテスト参加者は、2011 MAX Awardに応募することにより、次のことに同意したものとします。

  • コンテスト参加者は、主催者(ならびに主催者に代わってAdobe MAX ConferenceおよびAwardsに関する活動を行う認定代理店)が主催者とその製品・サービスの販売促進と広告宣伝のために、応募作品に含まれる構成要素の使用、複製、公開上演・展示、配布を、いずれの場合もAdobe MAX ConferenceおよびMAX Awardsとの関連において行うことを許可する限定的なライセンスを快く許諾します。このライセンスは、非排他的、ワールドワイド、無償、かつ完全支払済みです。コンテスト参加者はその構成要素の所有権を保持するものとします。

8. 一般条件

主催者は以下に対する責任を負わないものとします。

(i) 応募作品の紛失、遅延、損傷、不備、判読不能、不鮮明、および宛名違い。(ii) 電話、電気、ハードウェアもしくはソフトウェアプログラム、ネットワーク、インターネット、またはコンピュータにおけるあらゆる種類の誤動作、故障、または不調。(iii) コンピュータ通信の不通、一部不通、局所的不通、文字化け、または遅延。(iv) 主催者にとって不可避な事由による、コンテストの中断または中止を招きかねない状況。(v) 賞品もしくは賞品の授受、所有、使用に関連する、もしくは結果として発生する、またはコンテストへ参加したことにより発生する、あらゆる種類の負傷、損失もしくは損害。(vi) コンテストに関連する資料におけるあらゆる印刷ミスまたは誤植(スペインを除く)。(vii) コンテスト参加者が作品を制作中に起こした郡、州、または地域の法規制違反。主催者は、不正または技術的障害によりコンテストの運営、セキュリティ確保、または正常な進行が妨げられた場合、独自の判断によりコンテストを中断、中止、または変更する権利を有します。すべてのコンテスト参加者は、コンテストに関連する、または賞品を授受、所有もしくは使用した結果発生する人的傷害、死亡、物的損害、ならびに知的所有権、公開の権利、名誉、プライバシーの侵害に対する補償請求をも含む、あらゆる種類の損失、損害、権利、請求、訴訟に対する責任から主催者を免除するものとします。上記にかかわらず、インドに在住するコンテスト参加者の場合は、主催者の落ち度により人的傷害、死亡、または物的傷害が発生した場合に前述の免責事項を適用しないものとし、また、香港またはポルトガルに在住するコンテスト参加者の場合は、主催者の落ち度により人的傷害または死亡が発生した場合に前述の免責事項を適用しないものとします。スペインに在住するコンテスト参加者の場合は、主催者の一般的または軽微な落ち度により発生した場合にのみ前述の免責事項を適用するものとします。すべてのコンテスト参加者は、主催者が負うべき義務が、参加資格を満たした参加者によって提出された応募作品を本規定に定められた手順および基準に従って審査員に提出すること、ならびに、本規定に定められた賞品を定められた条件に従って受賞者に授与することのみであることに同意するものとします。コンテスト参加者は、主催者にはすべての応募作品に対して公正かつ十分な配慮を行う義務があること、ならびに、コンテスト参加者にはそれ以上の代償を求める資格がないこと、およびそれを求めないことに同意するものとします。

すべてのコンテスト参加者は、その応募作品が受賞作品に選ばれた場合、受賞の条件として、アドビ製品の広告宣伝のために、その作品の使用、複製、配布、公開上演、公開展示、改変をする権利、ならびに受賞作品を元に二次的著作物の制作を許諾する無償、非排他的、永続的なワールドワイドのライセンスを主催者に供与する使用許諾契約に署名するものとします。上記のような永続的なワールドワイドのライセンスが無効または執行不能であるという範囲内で、コンテスト参加者は、アドビ製品の広告宣伝のために、その作品の使用、複製、配布、公開上演、公開展示、改変をする権利、ならびに2011 MAX Award受賞作品を元に二次的著作物の制作を許諾する無償、非排他的、2年間のワールドワイドのライセンスを主催者に供与する使用許諾契約に署名するものとします。各参加者は、さらに、前記ライセンスを発効させるために必要ないかなる書類をも締結することに同意するものとします。

すべてのコンテスト参加者は、2011 MAX Awardに作品を応募することにより、その参加者が自らの個人情報、氏名、肖像および声を、コンテストに関連した広告または宣伝に無償で使用することを許可したものとします。本公式規定の構成、有効性、解釈、法的強制力に関する、またはコンテスト参加者および主催者のコンテストに関連する権利や義務にかかわる問題および疑問は、ポルトガルまたはスペインに在住するコンテスト参加者にかかわる問題を除き、カリフォルニア州法により支配され解釈されるものとし、カリフォルニア州以外の法が適用されるような抵触法の原則(カリフォルニア州および他の管轄における法および原則を含む)を適用しないものとします。法的に許される場合、コンテスト参加者は、コンテストの運営または受賞者選定以外でコンテストまたは授与された賞に起因または関連するすべての紛争、請求、訴訟原因を、いかなる形の団体訴訟にも訴えることなく個人で、および米国カリフォルニア北部連邦地方裁判所(サンノゼ支所)またはカリフォルニア州サンタクララ郡に在する所轄のカリフォルニア州裁判所の下で解決することに同意するものとします

受賞者リストを2011年10月4日以降にAdobe MAX Webサイトに掲示するものとします。

Regras oficiais dos Prêmios MAX 2011

A participação no Concurso de Prêmios MAX (o "Concurso") indica que o Concorrente aceita e concorda total e incondicionalmente com as Regras oficiais. O Concurso é patrocinado pela Adobe Systems Incorporated, 345 Park Ave. San Jose, CA USA 95110 (“Patrocinador”).

Termos e condições

1. Timing

O Concurso começa na sexta-feira, dia 3 de junho de 2011 e termina às 12h (meio-dia), Horário do Pacífico, do dia 29 de julho de 2011. Todas as inscrições serão divulgadas no site da competição até 12h (meio-dia), Horário do Pacífico, da sexta-feira, dia 29 de julho de 2011.

2. Eligibility

O Concurso está aberto a todas as pessoas maiores de 18 anos. O Concurso não está aberto aos habitantes dos seguintes países: Coreia do Norte, Cuba, Irã, Síria e Sudão. As regulamentações de exportação dos EUA proíbem a exportação de mercadorias e serviços para esses países. Desse modo, os habitantes dos países/regiões citados acima não estão qualificados a participar.

Também não estão qualificados a participar deste Concurso funcionários, executivos e diretores do Patrocinador, seus afiliados e consultores jurídicos, integrantes do comitê de juízes, familiares imediatos e pessoas que moram na mesma residência dessas pessoas.

Além disso, não estão qualificados a participar deste Concurso projetos financiados ou patrocinados pela Adobe ou especificamente desenvolvidos para a Adobe. Serão aplicadas todas as leis e regulamentações federais, estaduais, municipais, autônomas e locais. Quando houver proibição, será aplicada a anulação.

3. Categories & Judging

Todas as inscrições devem atender às exigências, conforme especificado a seguir na Seção 4. Quaisquer inscrições que não estejam em conformidade serão desqualificadas. Inscrições alteradas, apagadas, cortadas, ilegíveis ou incompletas serão desqualificadas. Inscrições que incluam qualquer conteúdo de natureza pornográfica, obscena ou sexualmente explícita, de acordo com os critérios exclusivos do Patrocinador, serão desqualificadas. Depois que cada inscrição for verificada em relação à conformidade com as exigências, ela será avaliada por um comitê de juízes formado por gerentes seniores da Adobe e especialistas do setor. As decisões dos juízes são finais e válidas legalmente. Os juízes têm o direito de reclassificar as inscrições de uma categoria para outra ou de selecionar somente componentes da inscrição para o prêmio. Cada uma das seis (6) categorias terá três finalistas selecionados e três prêmios de menção honrosa serão concedidos, a menos que os juízes definam que a qualidade da inscrição não garante a concessão de todos os prêmios.   • Alcance e monetização do aplicativo, com sucesso comprovado no aumento da receita e da lucratividade, na abertura de novos canais de receita e na disponibilização para clientes/públicos-alvo de maneiras novas de lidar com serviços e informações
  • Número de soluções da Adobe usadas para desenvolver o aplicativo
  • Capacidade de o aplicativo chamar a atenção de públicos-alvo em vários canais, como mídias sociais e outros meios de acesso, bem como estabelecer conversas bidirecionais entre os públicos-alvo e as empresas que oferecem serviços e seus parceiros, com o objetivo de obter o reconhecimento e a fidelidade do cliente
  • Implementação real e dinâmica suportada por dados e resultados de projeto mensuráveis

Nesta categoria, analisaremos como chefes de empresa e equipes de TI trabalharam para criar e gerenciar aplicativos que aumentam o padrão de serviço de uma organização, reduzem os custos e aumentam a receita por meio de uma melhor interação. Os aplicativos vencedores alcançarão vários dispositivos e integrarão estratégias de mídia social para interagir com públicos-alvo grandes e diversificados. Além disso, avaliaremos as respostas do público à medida que as organizações atraírem pessoas e as servirem quando elas solicitarem produtos ou acessarem serviços, gerenciarem correspondências e realizarem outras tarefas. Os aplicativos precisam estar em produção.

    A categoria Empresa digital: eficiência dos funcionários reconhece organizações que tenham criado uma solução que permita aos funcionários melhorar sua produtividade e servir melhor os clientes. Essa solução deve demonstrar a utilização da pesquisa de experiência do usuário para informar o design do aplicativo e destacar o modo como o aplicativo interage com informações e dados de sistemas de transação back-end (ERP, CRM, Legacy, etc.). A produtividade dos funcionários, a eficácia do processo e a melhoria do atendimento ao cliente também serão avaliadas, bem como o design geral da arquitetura do aplicativo e a experiência do usuário.

    Com as mudanças radicais na maneira como as pessoas acessam e consomem informações, os editores estão adotando novos modelos para monetizar a interação do cliente e alcançar públicos-alvo cada vez mais exigentes e informatizados em diversos dispositivos e canais. Nessa categoria, buscamos inscrições que mostram interações inéditas com os clientes e novidades em experiência de usuário criadas e fornecidas eletronicamente utilizando uma ou mais soluções da Adobe. A palavra-chave é inovação, algo que transforma as possibilidades de experiência de usuário e abre novas possibilidades tanto para empresas quanto para consumidores. Inovações recentes em multitoque, realidade aumentada, apresentações em várias telas, layout dinâmico, criações baseadas na comunidade e outras novidades que ainda serão descobertas são características dessa categoria.

  6. Entretenimento

    Há anos, as soluções da Adobe têm sido fundamentais para a criação e a oferta de experiências de entretenimento atraentes e envolventes. Esta categoria examina como as organizações usam as soluções da Adobe para aumentar a diversidade e a interatividade de cada produção, bem como para expandir o alcance do entretenimento no ambiente de várias telas e através das comunidades on-line das quais as pessoas participam atualmente. Em filmes ou na TV, em computadores, smartphones, tablets ou outros dispositivos, as inscrições vencedoras deverão destacar programas, jogos ou aplicativos que produzam resultados mensuráveis, interajam com o público-alvo via canais e ultrapassem os limites do que se achava possível.

4. How to Enter

  • Todos os concorrentes devem preencher o formulário oficial on-line para os Prêmios MAX 2011 disponível em http://www.adobemaxsubmission.com/submission. As inscrições devem incluir um URL de acesso ao trabalho enviado. Se não puder ser acessado publicamente via URL, o projeto poderá ser enviado por um URL da Web com um login especial somente para a Adobe. Se seu projeto for selecionado como Finalista, você deverá estar disponível para participar da conferência Adobe MAX 2010 e mostrar o projeto aos participantes, incluindo uma demonstração auto guiada.

É IMPRESCINDÍVEL que as inscrições:

  • Usem pelo menos um produto da Adobe em sua criação. Recomendamos a conclusão de projetos com a versão mais recente de vários produtos Adobe;
  • Estejam em produção ou em fase ativa de piloto até o início do MAX 2011 e estejam disponíveis e acessíveis em até 120 dias depois da conferência;
  • Sejam um trabalho original e não contenham plágio de imagens, textos ou outro conteúdo;
  • Não contenham material pornográfico, obsceno, difamatório ou ofensivo nem outro tipo de material ilegal, conforme determinado pelo Patrocinador de acordo com seus próprios critérios. Todas as inscrições que contiverem tal conteúdo serão desqualificadas;
  • Não sejam criadas especificamente para a Adobe ou com objetivo de obter patrocínio da Adobe.
  • Sejam criadas ou atualizadas após 27 de outubro de 2010

Todas as inscrições que não estiverem em conformidade com os requisitos apresentados não estarão qualificadas a receber prêmio algum. As inscrições podem ser enviadas para consideração em mais de uma categoria, mas só serão selecionadas como finalista ou como outro destaque em uma (1) categoria. Cada projeto será reconhecido somente uma vez. Se o mesmo projeto ou um projeto semelhante for enviado por duas organizações independentes, o projeto e cada organização poderão ser desqualificados do Concurso de acordo com os critérios do Patrocinador. O Patrocinador não se responsabiliza por inscrições perdidas ou danificadas. O Patrocinador tomará todos os cuidados razoáveis para impedir qualquer perda ou dano às inscrições recebidas; no entanto, o Patrocinador não será responsável por perdas diretas, indiretas ou consequenciais resultantes de perda ou dano de qualquer inscrição.

5. Copyright Ownership

Ao enviar uma inscrição de um único criador para uma categoria, o concorrente representa e garante que (i) é o único designer, criador e proprietário da arte final, o que inclui todos os componentes audiovisuais, ou que tem permissão para usar componentes com direitos autorais; e (ii) a arte final não contém informações consideradas confidenciais pelo local de trabalho do concorrente ou de qualquer terceiro. Ao enviar uma inscrição de um grupo de criadores, os concorrentes representam e garantem: (i) que desenvolveram, criaram e possuem a arte final audiovisual como um grupo ou que têm permissão para usar componentes com direitos autorais; e (ii) que a arte final não contém informações consideradas confidenciais pelo local de trabalho dos concorrentes ou de qualquer terceiro.

6. Prizes

Os primeiros três finalistas serão selecionados em cada uma das seis (6) categorias ("Finalistas") e convidados a participar do evento Adobe Max 2010, em Los Angeles, Califórnia, EUA ("Evento"). Cada Finalista receberá um registro complementar para o Evento, que será apresentado nessa ocasião. Para cada uma das seis (6) categorias, será concedido um Prêmio MAX a um dos três primeiros Finalistas ("Vencedores de categoria"), que será escolhido pelo público em votação on-line. Cada Vencedor de categoria receberá um Prêmio MAX no Evento.

  • Finalista: Os três primeiros Finalistas serão selecionados em cada uma das seis (6) categorias. Cada Finalista receberá um registro complementar para o Adobe MAX 2011 e deverá ser divulgado no evento, na conferência, nos materiais de marketing e no Adobe.com. As despesas com viagem e acomodação serão de responsabilidade do finalista.
  • Vencedor de categoria: Um dos três primeiros Finalistas será selecionado em cada uma das seis (6) categorias ("Vencedor de categoria") pelo público em votação on-line. Cada Vencedor de categoria receberá um troféu Prêmio MAX no Evento, reconhecido na conferência, nos materiais de marketing e no site Adobe.com e será incluído na divulgação à imprensa, emitida pela Adobe, anunciando os vencedores.
  • Menção honrosa: Serão selecionados três (3) projetos em cada uma das seis (6) categorias como Menção honrosa. Cada Menção honrosa será apresentada no site Adobe.com, juntamente com um logotipo e uma breve descrição do projeto. Além disso, as Menções honrosas podem ser divulgadas no Evento, na conferência, nos materiais de marketing e no site Adobe.com. A Adobe se reserva o direito de não conceder nenhum prêmio de Menção honrosa.

Como este é um concurso de habilidades, o vencedor será escolhido com base na qualidade da inscrição recebida. Todos os prêmios serão concedidos, a menos que haja menos inscrições qualificadas para uma Categoria que os prêmios para essa Categoria ou se os juízes decidirem que a qualidade das inscrições não garante um prêmio. Não será permitido nenhum prêmio alternativo, dinheiro ou outra substituição, exceto pelo Patrocinador na hipótese de indisponibilidade do prêmio. Os prêmios não podem ser transferidos nem concedidos. Todos os impostos federais, estaduais, municipais e locais são de responsabilidade exclusiva dos vencedores.

7. Finalist Notification

As inscrições serão julgadas entre 20 de junho de 2011 e 18 de agosto de 2011. Dezoito (18) Finalistas, três em cada categoria, serão notificados por e-mail ou por telefone na semana de 22 de agosto de 2011.

Após o recebimento da notificação, os Finalistas terão 2 dias (48 horas) para reconhecer o status de finalista e confirmar, por e-mail, sua participação no Evento. Os finalistas serão notificados de sua indicação, mas não saberão qual a colocação do prêmio até o Evento. O Patrocinador não é responsável e nem deverá ser responsabilizado por esforços atrasados, perdidos, mal-orientados ou fracassados de notificar os vencedores. Se um Finalista selecionado não puder ser contatado, não estiver qualificado, não confirmar o status de finalista ou não cumprir com qualquer termo ou condição destas Regras oficiais, um Finalista alternativo poderá ser selecionado. Os finalistas deverão seguir o contrato de licença de participação, apresentado e aceito durante o registro na competição, como condição para avançar na competição e possivelmente receber um prêmio. Os finalistas poderão ser solicitados a assinar fisicamente o contrato de participação para continuar na competição. O texto do contrato de licença de participação acordado previamente é o seguinte:

Cada Concorrente concorda que ao enviar uma inscrição para o Prêmio MAX 2011:

  • Ele ou ela concede uma licença limitada para a Adobe (e para os agentes autorizados que atuam em nome da Adobe em assuntos relacionados à Conferência e aos Prêmios Adobe MAX) para uso, reprodução, execução ou exibição pública e distribuição de materiais incluídos na inscrição para fins de marketing e promoção da Adobe e de seus produtos e serviços em conexão com a Conferência Adobe MAX e com os Prêmios MAX. Essa licença é não exclusiva, mundial e isenta de royalties e descontos. Você manterá a propriedade dos Materiais.

8. General Terms and Conditions

O patrocinador não é responsável nem deverá ter obrigações em relação a:

(i) inscrições perdidas, atrasadas, adiadas, danificadas, incompletas, ilegíveis, incompreensíveis; (ii) mau-funcionamento, falhas ou dificuldades de qualquer tipo relacionados a dispositivos eletrônicos, hardware, software, rede, Internet ou computador; (iii) transmissões de computador com falha, incompletas, parciais, distorcidas ou atrasadas; (iv) qualquer condição causada por eventos além do controle do Patrocinador que possam interromper ou corromper o Concurso; (v) quaisquer lesões, perdas ou danos que surjam em conexão com ou como o resultado de um prêmio, da aceitação, da posse ou do uso de um prêmio, ou da participação no Concurso; (vi) quaisquer erros de impressão ou tipográficos em quaisquer materiais associados ao Concurso (não se aplica na Espanha); (vii) quaisquer leis ou regulamentações regionais, estaduais e independentes violadas durante a criação de inscrições pelo(s) Concorrente(s). O Patrocinador se reserva o direito de suspender, cancelar ou modificar o Concurso se qualquer fraude ou falha técnica corromper a administração, a segurança ou a execução correta do Concurso, conforme determinado por decisão exclusiva do Patrocinador. Cada Concorrente concorda em isentar o Patrocinador de todos e quaisquer direitos, perdas, danos, reivindicações e ações de qualquer tipo, em conexão com o Concurso ou resultantes da aceitação, da posse ou do uso de qualquer prêmio, inclusive, não se limitando a, lesão pessoal, morte, dano à propriedade e reivindicações com base em violação de propriedade intelectual, direitos de publicidade, difamação e invasão da privacidade. Não obstante o exposto anteriormente, a isenção precedente de responsabilidade não se aplicará em relação a lesão pessoal, morte ou dano à propriedade causado por negligência do Patrocinador em relação aos Concorrentes residentes na Índia, e não se aplicará em relação a lesão pessoal ou morte por negligência do Patrocinador em relação aos Concorrentes residentes em Hong Kong ou em Portugal. A isenção precedente de responsabilidade se aplica somente à negligência comum ou secundária pelo Patrocinador em relação a Concorrentes residentes na Espanha. Cada Concorrente concorda que a única obrigação do Patrocinador é enviar as inscrições dos Concorrentes qualificados aos juízes, de acordo com os procedimentos e os critérios definidos anteriormente nestas Regras oficiais, e conceder os prêmios definidos neste documento aos vencedores, de acordo com os termos e as condições neste documento. O Concorrente concorda que a obrigação do Patrocinador é a consideração justa e adequada de qualquer inscrição enviada e que o Concorrente não terá direito a compensações adicionais nem deverá exigir nenhuma compensação adicional.

Cada Concorrente concorda que, se sua inscrição for selecionada como inscrição vencedora, como condição para receber o prêmio, o Concorrente deverá assinar um contrato de licença concedendo ao Patrocinador uma licença isenta de royalties, não exclusiva, perpétua e mundial para uso, reprodução, distribuição, execução pública, exibição pública, modificação para fins de execução e exibição públicas e preparo de trabalhos derivados com base na inscrição do vencedor, para fins de publicidade e promoção dos produtos Adobe, e para inclusão e distribuição com os produtos Adobe. Se para isso tal licença perpétua for ineficaz e não aplicável, o Concorrente deverá assinar um contrato de licença concedendo ao Patrocinador uma licença isenta de royalties, não exclusiva, perpétua e mundial de dois (2) anos para uso, reprodução, distribuição, execução pública, exibição pública, modificação para fins de execução e exibição públicas e preparo de trabalhos derivados com base na inscrição do vencedor no Prêmio MAX 2011, para fins de publicidade e promoção dos produtos Adobe e para inclusão e distribuição com os produtos Adobe. Além disso, cada Concorrente concorda em executar todo e qualquer documento necessário para efetuar tal licença.

Cada Concorrente concorda que ao enviar uma inscrição para o Prêmio MAX 2011, ele ou ela permite o uso de seus dados pessoais, nome, imagem e/ou voz em publicidade ou propaganda relacionada ao Concurso sem compensação. Exceto em relação aos problemas que afetam os Concorrentes residentes de Portugal ou da Espanha, todos os problemas e questões relativos à construção, à validade, à interpretação e à aplicação destas Regras oficiais, ou os direitos e as obrigações do Concorrente e do Patrocinador em conexão com o Concurso, serão regidos e interpretados de acordo com as leis do Estado da Califórnia, sem permitir efeito de vigência a qualquer escolha de lei ou conflito de regras ou cláusulas de leis (independentemente de ser no Estado da Califórnia ou em qualquer outra jurisdição), pois isso causaria a aplicação das leis de qualquer jurisdição que não do Estado da Califórnia. Sempre que permitido por lei, o Concorrente concorda que todos e quaisquer litígios, ações e causas de ação decorrentes de ou em conexão com este Concurso, ou quaisquer prêmios concedidos, que não sejam a administração do Concurso ou a determinação dos vencedores, serão resolvidos individualmente, sem recorrer a qualquer forma de ação, e exclusivamente pelo Tribunal Regional dos Estados Unidos do Distrito Norte da Califórnia (Divisão de San Jose) ou o Tribunal Estadual da Califórnia, localizado no Condado de Santa Clara, na Califórnia.

A lista de Vencedores será publicada no site Adobe MAX depois de 4 de outubro de 2011.
